These Terms of Use ("Terms") govern your use of the OpSpot mobile application and website at opspotapp.com (together, the "Service"), operated by us ("we", "us", or "our"). By creating an account, signing in, or otherwise using the Service, you agree to these Terms. If you do not agree, do not use the Service.
The Service
OpSpot helps people discover and share photo spots. The Service may include maps, spot details, saved lists, profiles, and community features such as photos, captions, and comments ("User Content").
Accounts
You may use some features without signing in. To sync data across devices, follow people, or contribute User Content, you must sign in with Apple or Google. You are responsible for activity under your account and for keeping your sign-in method secure.
User Content and community standards
You are solely responsible for User Content you post. You retain ownership of your content, and you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and distribute that content as needed to operate and improve the Service.
We have a zero-tolerance policy for objectionable content and abusive users. You may not post, upload, or share content that is illegal, pornographic, harassing, hateful, violent, fraudulent, spam, or otherwise harmful; that infringes others' rights; or that misleads others about a place or safety. You may not abuse, threaten, or harass other users.
We may remove content, restrict features, or suspend or terminate accounts that violate these Terms or our community standards, with or without notice, including when we receive reports from other users.
Reporting and blocking
The app provides tools to report inappropriate spots, photos, and comments, and to block other users. Blocking hides that user's content from your feed. We review reports and aim to act on them promptly (typically within 24 hours). You can also contact us using the details below.
Premium and purchases
Some spots or features may require a paid unlock or subscription purchased through the App Store. Payment, billing, refunds, and cancellations for those purchases are handled by Apple under Apple's terms. We do not control App Store billing.
Acceptable use
- Do not attempt to disrupt, scrape at abusive scale, reverse engineer, or misuse the Service
- Do not impersonate others or misrepresent your affiliation
- Do not use the Service for unlawful purposes
Intellectual property
The Service, branding, and curated spot data we provide are protected by intellectual property laws. You may not copy or redistribute our materials except as allowed by these Terms or with our written permission.
Disclaimers
Spot information (including locations, tips, and community photos) is provided for discovery and inspiration. Conditions change; always use your own judgment and follow local laws and safety rules. The Service is provided "as is" without warranties of any kind to the fullest extent permitted by law.
Limitation of liability
To the fullest extent permitted by law, we are not liable for indirect, incidental, special, consequential, or punitive damages, or any loss of data, profits, or goodwill arising from your use of the Service.
Privacy
Our Privacy Policy explains how we collect and use personal information. By using the Service, you also acknowledge that policy.
Termination
You may stop using the Service at any time and may delete your account in the app. We may suspend or end access if you violate these Terms or if we discontinue the Service.
Changes
We may update these Terms from time to time. We will post the revised version on this page and update the "Last updated" date. Continued use after changes means you accept the updated Terms.
